Hard not to feel a bit of schadenfreude in response. But Luke is right. US constitutionalism elevates a body of permanent law over politics. Hence, it elevates legal interpreters in the form of a federal judiciary over the more ostensibly political branches. The more the constitutional structure breaks down, the more democracy withers and dies.
